These Terms of Service describe the conditions for using constructionestimation.us and engaging Construction Estimating LLC (“we,” “us,” or “our”).
The scope, fees, payment schedule, delivery date, and deliverables for each project are established in a written quotation or service agreement accepted by the client. Project-specific terms take precedence where they conflict with these general terms, subject to applicable law.
Our Services
We provide construction quantity takeoffs, material takeoffs, labor-hour estimating, cost estimating, and related estimating support.
All services are performed remotely using the documents and information supplied by the client. We do not conduct site visits or physical measurements.
Depending on the agreed scope, deliverables may include BOQs, spreadsheets, drawing markups, labor hours, cost estimates, assumptions, exclusions, and supporting views.
Submitting an enquiry or uploading plans does not place an order or create an obligation to purchase services.
Client Responsibilities
The client is responsible for providing complete and current drawings, specifications, scope instructions, addenda, project location, and other relevant information.
The client must:
- Identify the required trades, deliverables, and deadline.
- Notify us of revisions or changes to the project.
- Have authority to share submitted documents.
- Inform us of confidentiality requirements or restrictions on external estimator access before work begins.
- Review completed deliverables before using them for bidding, purchasing, contracting, or construction.
Missing information, conflicting documents, or later revisions may require clarification, additional fees, or changes to the delivery schedule.
Basis and Limitations of Estimates
Takeoffs and estimates are based on the documents available, the agreed scope, and stated assumptions.
Where cost estimating is requested, we may use RSMeans Data, project-location adjustments, and client-supplied pricing. These are estimating inputs and may differ from current supplier quotations, subcontractor bids, or actual project costs.
Our services do not guarantee final construction costs, actual field quantities, project profitability, or successful bids.
Unless expressly agreed in writing, our services do not include architectural or engineering design, site inspections, permit approval, or verification of regulatory compliance.
Fees and Payment
Fees, deposits, payment deadlines, and delivery arrangements are stated in the accepted quotation or agreement.
Changes to drawings, additional trades, revised quantities, or work outside the original scope may require a separate quotation.
We will communicate additional charges for approval before proceeding with extra work. Overdue payments may affect the scheduling or release of deliverables, subject to the agreed terms and applicable law.
Delivery and Revisions
Delivery dates depend on receiving the agreed documents, instructions, and required payments on time.
If you identify an apparent error, please notify us promptly and identify the relevant drawing, item, or calculation. We will review the concern against the agreed scope and source documents and correct errors attributable to our work.
Changes caused by new documents, revised instructions, or additional scope may be charged separately.
Cancellations and Refunds
Cancellation requests must be submitted in writing.
If work has not started, payments for the cancelled work will be refunded, except for any separately approved, nonrecoverable third-party expenses already incurred.
If work has started, any refund will take account of work completed and approved expenses. We will explain the basis of any deduction.
Completed work is not automatically refundable because a project is postponed, cancelled, or does not result in a successful bid. Concerns about errors or incomplete deliverables will be reviewed against the agreed scope.
Project-specific cancellation terms apply where agreed in advance. Nothing in this policy limits rights or remedies that cannot be excluded under applicable law.
Documents and Intellectual Property
Ownership of supplied drawings and documents remains with their respective rights holders.
You authorize us to use submitted materials for reviewing and performing the requested services. This authorization does not permit us to publish your project materials for marketing without separate permission.
Upon payment of agreed fees, you may use the delivered takeoffs and estimates for the agreed project and business purpose. Our pre-existing templates, methods, and internal tools remain our property unless otherwise agreed.
Third-party materials and data remain subject to their applicable licenses.
Website Use
You must not misuse the website, attempt unauthorized access, upload malicious or unlawful material, or submit documents that infringe another party’s rights.
Website information is general in nature and does not replace a project-specific estimate or professional advice appropriate to your project.
Responsibility and Disputes
Please contact us promptly if an issue arises so we can investigate and seek a practical resolution.
Responsibility for a paid engagement is determined by the accepted project agreement and applicable law. Nothing in these terms excludes liability or legal rights that cannot lawfully be excluded.
Changes to These Terms
We may update these terms by publishing a revised version. Updated terms will not retrospectively change an existing engagement without agreement.
